Agreement
These terms are an agreement between you and Gal Cohen, an individual in Israel (“Gasp”, “we”). By creating, sending or opening a Gasp, you agree to them and to our privacy policy. These terms apply equally to all genders.
The test period
Gasp is in a free test period. Senders sign up with an email address and create their own Gasps. Nothing is charged during the test, and the sections on prices and payment apply once paid Gasps open.
Who can use Gasp
- Senders must be 18 or older. You sign in with an email address you control and are responsible for activity on your account.
- Recipients don't need an account. Opening a link, watching, recording and sending a reaction are always free and optional.
What Gasp does
Gasp turns your photos and words into a short reveal of your news, which you send to someone by link. The recipient decides whether their reaction is recorded and, after watching it, whether to send it to you and who else may see it. We use AI to arrange your photos and draft short texts, which are reviewed and approved before the Gasp is sent.
We work to keep Gasp available and working well, but we can't promise every device or browser will support every feature, such as the camera or a gesture. Gasp may change over time.
Your content
You keep ownership of everything you upload or record. You give Gasp permission to store, process, adapt and display it only as needed to provide Gasp to you and the people you send it to, for the storage period in our privacy policy. We won't use your content or reactions in our marketing without separate written consent from the people shown.
If you are a sender, you confirm that:
- you have the right to use every photo, text and recording you provide;
- the people shown in your photos agree to appear in a Gasp sent to your recipient;
- if your recipient is under 18, you are their parent or legal guardian.
If you are a recipient, your reaction belongs to you. You decide whether to send it, who may see it, and whether to approve any public post. You can delete it from our servers at any time.
Respecting the recipient's choices
- Don't share a reaction more widely than the recipient allowed.
- Don't post a reaction publicly without the recipient's approval for that post. A child's reaction may never be posted publicly.
- Don't try to record anyone without their knowledge, or work around Gasp's consent steps.
What Gasp may not be used for
Gasp is for good news. You may not use it:
- for pranks, fake bad news, or anything meant to frighten, upset or humiliate;
- to harass, threaten or bully anyone, or to send content they have asked not to receive;
- for sexual content, or any content involving the exploitation of children;
- for unlawful, hateful or violent content, or content that infringes someone else's rights;
- to send spam, advertising or deceptive content, or to impersonate someone;
- to interfere with Gasp's systems, bypass its limits, or copy it at scale.
We may review content that is reported to us or flagged by our automated checks, remove it, and stop serving senders who break these rules. Where required by law, we report illegal content, including child sexual abuse material, to the authorities.
Music and AI texts
Music in Gasp videos is licensed so you can share your videos personally, including on social media. You may not use it separately or commercially. AI-drafted texts may contain mistakes and are reviewed before sending.
Prices and payment
Paid Gasps aren't on sale yet. When they open:
- Each account has one free Gasp: one recipient, a 15–20 second video with the Gasp watermark, and 30 days of storage. AI designs are limited to 10 a day per account.
- Paid Gasps are shown with their price before you pay, including VAT. Prices will start at ₪39 for one recipient and ₪79 for up to six. A paid Gasp removes the watermark and includes high-quality video, the full uncut reaction and 12 months of storage.
- Our order process is conducted by our online reseller Lemon Squeezy, which is the merchant of record for your order: it processes the payment, charges any applicable taxes and sends your receipt by email. You will be able to pay by credit card, PayPal, Apple Pay or Google Pay.
- Each purchase is for the specific Gasp shown at checkout. There are no subscriptions or automatic renewals.
Cancellation and refunds
Cancellations and refunds follow our refund policy (seegasp.com/refunds): a full refund within 14 days of the purchase if the Gasp hasn't been sent yet, through Lemon Squeezy to the original payment method. Nothing in it limits your rights under the Consumer Protection Law, 1981, and its regulations.
If a paid Gasp fails because of a fault on our side, for example the video is never created, we will refund you in full or fix it, as you prefer.
Storage and downloads
Gasp is not a permanent archive. Files are deleted at the end of the storage period in our privacy policy, so download anything you want to keep.
Our responsibility
Gasp is provided as it is and as available. To the extent the law allows, we are not responsible for indirect losses, for how other people use content you or they chose to share, or for a moment that couldn't be captured because of a device, browser or connection problem. Our total responsibility to you for any claim is limited to the amount you paid us in the 12 months before it, or ₪100 if you paid nothing. Nothing in these terms limits rights you have as a consumer that the law doesn't allow us to limit.
Ending the service
You can stop using Gasp and ask us to delete your Gasps at any time. We may stop serving a sender who breaks these terms, and we may stop offering Gasp with reasonable notice to senders, in which case we will refund unused paid Gasps and give you time to download your files.
Law and disputes
These terms are governed by the laws of the State of Israel. Disputes will be decided by the competent courts in Tel Aviv-Yafo, without limiting any right you have as a consumer to bring a claim where the law allows.
Changes
We may update these terms. We will post the new version with its date and notify senders of important changes before they take effect. Changes don't apply to Gasps already paid for.
